Consigli non richiesti per aumentare la produzione delle dosi di vaccino (#licenza obbligatoria)

Si leggono in questi giorni notizie allarmanti sulle difficoltà di alcune aziende farmaceutiche a produrre la quantità di dosi di vaccino promesse sulla base dei contratti stipulati con la Commissione UE e/o con i singoli paesi membri. Sarebbe necessario uno sforzo sovrumano per riuscire a vaccinare tutta la popolazione europea (e mondiale) entro l’estate.

 Un contributo alla soluzione di questo dramma potrebbe venire dal Diritto della Proprietà Industriale.
L’art. 70 (#Licenza obbligatoria per mancata attuazione) del #Codice della Proprietà Industriale (decreto legislativo 10 febbraio 2005, n. 30) prevede che qualora il titolare di un brevetto stia attuando l’invenzione in misura tale da risultare “in grave sproporzione con i bisogni del Paese”, l’Ufficio Italiano Brevetti (#UIBM) può concedere la #licenzaobbligatoria per l'uso non esclusivo dell'invenzione medesima, a favore di ogni interessato che ne faccia richiesta.

 Un meccanismo simile è previsto anche negli altri Stati membri UE (#compulsory licence). Gli #accordi TRIPS stabiliscono regole specifiche in caso di concessioni di una licenza obbligatoria.
Se le aziende farmaceutiche titolari del brevetto sulle varie tipologie di vaccini autorizzati, non sono in grado di a fornire le quantità di dosi promesse, tantissime aziende farmaceutiche nella UE potrebbero produrre le dosi di vaccino nel minor tempo possibile. Ovviamente, queste aziende licenziatarie pagherebbero al titolare del brevetto la relativa royalty sulla base del consolidato sistema delle regole #FRAND (fair, reasonable, and non-discriminatory royalty).

È assolutamente necessario il contributo di tutti per risolvere le questioni sanitarie connesse alla #pandemia. E i governi UE, anziché minacciare azioni legali e richieste di risarcimento di danni, potrebbero usare le regole IP già presenti nell’ordinamento per forzare le Big Pharma a produrre e/o a consentire alle concorrenti di produrre il maggior quantitativo possibile di dosi di vaccino.

Unsolicited advice to increase the production of vaccine doses (# compulsory license)

Recently we have witnessed alarming news about the difficulties of some pharmaceutical companies producing the quantity of vaccine doses promised on the basis of contracts signed with the EU Commission and / or with individual member countries. A superhuman effort would be needed to be able to vaccinate the entire European (and world) population by the summer.

A contribution to the solution of this drama could come from Industrial Property Law.
Art. 70 (#Mandatory license for failure to implement) of the #Code of Industrial Property (Legislative Decree 10 February 2005, n. 30) provides that if the owner of a patent is implementing the invention to an extent that is "in serious disproportion with the needs of the country ", then the Italian Patent Office (#UIBM) can grant the mandatory #license for the non-exclusive use of the invention itself, in favor of any interested party requesting it.

 A similar mechanism is also foreseen in the other EU Member States (#compulsory license). The TRIPS #Agreements establish specific rules in the event of a compulsory license being granted.
If the pharmaceutical companies holding patents on the various types of authorized vaccines are unable to deliver the promised quantities of doses, many EU pharmaceutical companies could produce the vaccine doses in the shortest possible time. Obviously, these licensees would pay the patent owner the relative royalty on the basis of the well-established #FRAND (Fair, Reasonable, AndNnon-Discriminatory royalty) system of rules.

Everyone's contribution is absolutely necessary to resolve the health issues related to the #pandemic. EU governments could use the IP rules already present in the legal system to force Big Pharma to produce and / or allow competitors to produce as many vaccine doses as possible, instead of threatening legal actions and claims for damages.
